Terms and Conditions

Effective Date: January 1, 2026

 These Terms of Service (“Terms”) govern your access to and use of Stenner.com (the “Site”), including any purchases of products or services made through the Site, and are entered into by and between you and Stenner Pump Company(“Stenner,” “we,” “us,” or “our”). By accessing the Site, creating an account (if offered), or placing an order, you agree to these Terms.

If you do not agree to these Terms, do not use the Site or place orders.

 2) Changes to these Terms

We may update these Terms at any time. Updates are effective when posted, as shown by the “Last Updated” date. Your continued use of the Site after posting means you accept the changes. Orders placed before updates are governed by the Terms in effect at the time of purchase.

 3) Privacy and cookies

 4) Eligibility

You must be at least 18 years old (or the age of majority where you live) to place an order. By placing an order, you represent that you can enter into a binding contract.

If you are purchasing on behalf of a company, you represent that you have authority to bind that entity, and “you” includes the entity.

5) Accounts

To access certain features of the Site (such as order history, saved addresses, saved carts, invoices, pricing, or other account-related tools), you may be able to create an account (an “Account”).

5.1 Registration and Accuracy

When creating an Account, you agree to:

  • provide accurate, current, and complete information, and

  • promptly update your information if it changes.

We may refuse, suspend, or terminate an Account if information is inaccurate, incomplete, or if we suspect unauthorized or fraudulent activity.

5.2 Account Security

You are responsible for maintaining the confidentiality of your username and password and for restricting access to your Account. You agree to notify us immediately at sales@stenner.com if you suspect any unauthorized access or use of your Account.

You are responsible for all activity that occurs under your Account, including purchases, unless prohibited by applicable law.

5.3 Business Accounts; Authorized Users

If you create or use an Account on behalf of a company or other organization:

  • you represent you have authority to bind that entity to these Terms, and

  • you are responsible for ensuring that any employees, contractors, or other authorized users who access the Account comply with these Terms.

You are responsible for maintaining appropriate internal controls over who is authorized to place orders, access invoices, or view pricing through the Account.

5.4 Suspension or Termination

We may suspend or terminate your Account (and/or restrict access to certain Site features) at any time if we reasonably believe:

  • you have violated these Terms,

  • there is suspected fraud, abuse, or unauthorized activity,

  • it is necessary to protect our customers, our business, or the Site.

You may request to close your Account by contacting sales@stenner.com. Account closure may not eliminate obligations related to prior purchases (including payment obligations) or rights that by their nature should survive termination.

6) Product information; availability

We try to display product descriptions, specifications, pricing, and availability accurately. However:

  • product images are illustrative and may vary from actual products
  • descriptions/specifications may change without notice
  • inventory and availability are not guaranteed until an order is accepted

We reserve the right to correct errors and update information at any time.

 7) Pricing; taxes

All prices are shown in [USD] unless otherwise stated. Prices may change at any time before you place an order.

Sales tax (and other applicable taxes/fees) will be added at checkout as required by law.

 8) Order process; acceptance; cancellations

Order submission is an offer to buy. We may accept or decline your order for any reason, including if:

  • an item is out of stock or discontinued
  • there are pricing or listing errors
  • we suspect fraud or unauthorized activity
  • shipping restrictions apply
  • credit account is on credit hold

 Order acceptance occurs when we send an order confirmation that indicates acceptance.

We may cancel orders, in whole or in part, and refund any amounts paid if an order cannot be fulfilled.

 9) Payment

We accept the payment methods displayed at checkout, which may include credit/debit card, ACH/bank transfer, and other options made available by our payment processors. By submitting payment information, you represent you are authorized to use the selected payment method.

  • Card/Online payments: Payment is due at the time you place the order (or at shipment, depending on checkout configuration).

 We may place an authorization hold and/or charge your payment method when the order is placed or when it ships, depending on how checkout is configured.

  • Invoice/Credit (Net) terms: Payment is due according to the approved net terms described below.

 Invoices will be provided electronically (email, customer portal, EDI, or other methods). You agree that electronic invoices and related notices satisfy any legal requirements for written notice.

 10) Shipping; delivery; risk of loss

Shipping options, costs, and estimated delivery times will be shown at checkout or during quoting.

Title and risk of loss pass to you upon [shipment / delivery].

Choose one:

  • Upon shipment (common for many online merchants)
  • Upon delivery (more consumer-friendly)

 Delivery dates are estimates and not guaranteed. We are not responsible for delays due to carriers, weather, supply constraints, or events beyond our control.

 11) Shipping Territory; U.S. and Canada Only

Stenner sells and ships products through this Site only to addresses in the United States and Canada (the “Permitted Territories”). We do not accept orders for delivery outside the Permitted Territories.

If you attempt to place an order for delivery outside the Permitted Territories, we may reject or cancel the order. If payment has been collected, we will refund the purchase amount in accordance with our policies.

11.1 Canada-Specific Terms (Duties/Taxes)

For shipments to Canada, unless expressly stated otherwise in writing:

  • you are responsible for all applicable import duties, taxes (including GST/HST/PST/QST), brokerage fees, and customs charges, and

  • delivery timelines may vary due to customs clearance and carrier processes.

11.2 Compliance

You are responsible for ensuring that products purchased are imported, used, and disposed of in compliance with applicable laws, regulations, and standards in your jurisdiction.

 12) Returns, refunds, and exchanges

Return eligibility, timelines, condition requirements, and any restocking fees are described in our Returns Policy:

Unless required by law:

  • shipping charges are non-refundable
  • refunds are issued to the original payment method after inspection/approval

13) Warranty; product support

Products may be covered by Stenner’s limited warranty and/or manufacturer warranties, as described in our Warranty Policy or product documentation:

EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN WARRANTY, PRODUCTS ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

 14) Safety and proper use

You are responsible for selecting appropriate products and using them safely and in accordance with manuals, labels, and applicable regulations. Certain products may require professional installation or handling.

15) Promotions; coupons; gift cards (if applicable)

Promotions and coupon codes are subject to additional terms and may:

  • expire
  • be limited to one per customer/order
  • exclude certain products
  • be revoked in cases of suspected misuse

16) Prohibited conduct

You agree not to:

  • misuse the Site or attempt unauthorized access
  • interfere with Site operation, including by introducing malware
  • scrape or harvest data at scale without permission
  • use the Site for fraudulent transactions

 17) Intellectual property

The Site and its content are owned by or licensed to Stenner and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission, except as allowed by law.

18) Third-party links and services

The Site may include third-party services (payment processors, shipping tools, analytics, embedded video) or links. We are not responsible for third-party content or practices.

 19) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, STENNER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

20) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STENNER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PURCHASE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STENNER’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR PRODUCTS PURCHASED THROUGH THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM (OR USD $100, WHICHEVER IS GREATER).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

 21) Indemnification

You agree to defend, indemnify, and hold harmless Stenner and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, misuse of the Site, or violation of laws or third-party rights.

 22) Governing law; venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Duval County, Florida, unless arbitration is required by law or chosen below.

 23) Termination

We may suspend or terminate access to the Site at any time to protect the Site, customers, or our rights, or if we reasonably believe you have violated these Terms.

 24) Miscellaneous

  • Severability: If any provision is unenforceable, the rest remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Entire agreement: These Terms plus linked policies (Privacy) form the entire agreement regarding Site use and purchases.
